Garfield man indicted on charges of raping woman while she slept

YOU READ IT HERE FIRST: A Garfield man who authorities said raped a woman while she slept in his apartment after the two hung out earlier that night was indicted by a grand jury in Hackensack.

The four-count indictment charges Adam Niemira, 28, with first-degree aggravated sexual assault for having forced intercourse with and fondling the breasts of a victim whom he “knew or should have known was physically helpless, mentally defective or mentally incapacitated” last Aug. 15.

The 26-year-old woman told authorities that she awoke in Niemira’s second-floor Woods Street apartment to find him “engaging her in sexual intercourse,” Bergen County Prosecutor John L. Molinelli said following the arrest.

“The victim struggled briefly [before] leaving the residence and returning home,” the prosecutor said.

She called Garfield police, who notified Molinelli’s Special Victims Unit. Together they interviewed the woman, who the prosecutor said “provided details of what had occurred and stated that she had not consented to engaging in any type of sexual activity” with Niemara.

Niemira, who is single and unemployed, remained held on $150,000 bail this morning in the Bergen County Jail.
