Assistant Bergen County Prosecutor Nicholas Ostuni requested the guilty plea to avoid having to bring the victim to court if 19-year-old Angelo M. Consoli of Fort Lee doesn’t complete the intervention program successfully.

Consoli was 17 when authorities took him into custody as a juvenile following the January 2013 incident. Based on a skull fracture suffered by the victim, the case was waived to adult status.
“My client makes no excuse for his actions,” defense attorney S. Emile Lisboa told Presiding Superior Court Judge Liliana DeAvila-Silebi on Friday.
“He’s gone through a lot. He got kicked out of the Demarest high school in his senior year. He graduated and is now working,” Lisboa said. “He hasn’t gotten into any other trouble in the interim.”
At Consoli’s age, “the next couple of years are very important and will tell us what direction he’s going to be heading in,” the attorney said.
PTI supervision will continue for three years, during which Consoli cannot have any contact with the victim.
If he completes the program successfully, his record will be cleared (and this story will be removed).
If not, he will face charges of second-degree aggravated assault and third-degree attempted serious bodily injury. His $25,000 bail would also be revoked.
