Officers responding to a disturbance call from the Lemoine Avenue fast-food restaurant near the George Washington Bridge on May 27 said they spotted Malick and Malcolm Mitchell, both 36, trying to flee.

Malick Mitchell of Brooklyn (above, right), “began to resist when officers attempted to take him into custody,” Fort Lee Police Chief Keith Bendul said at the time. Malcom Mitchell, of Manhattan (left), “fled on foot and was chased by plainclothes detectives,” he said.

As the officers were trying to take Malick Mitchell into custody, he “pushed one officer and then kicked another officer before being subdued,” the chief said.

Watching video and interviewing employees, officers and detectives determined that both began threatening the workers and throwing chairs when they were denied free food.

They “damaged cash registers, windows and the large Ronald McDonald figure inside of the establishment [while] continually threatening the work staff,” Bendul said.

Police charged the Mitchell brothers with robbery, resisting arrest, criminal mischief and related charges.

Malcolm Mitchell, who was also charged with terroristic threats and two counts of aggravated assault on police, was taken to Englewood Medical Center with minor injuries, Bendul said.

Malcolm Mitchell posted $35,000 bail on June 17 and was released from the Bergen County Jail.

Malick Mitchell was released on Sept. 24 after posting $7,500 bail.
