“My client has been in jail since March 18, and he hasn’t been indicted,” the attorney for 22-year-old Hamilton Sanchez-Olmo told Presiding Superior Court Judge Liliana DeAvila Silebi.
Assistant Bergen County Prosecutor Will Miller, in turn, requested a 2½-week extension, which the judge granted.
Miller noted that an alleged accomplice in the holdups was only just arrested on Aug. 6 as part of an ongoing investigation.
That man, 35-year-old Emsha Wellington of Lodi, was tracked down and grabbed in Parlin in connection with the March 17 armed robbery of a 7-Eleven in Lodi.
Authorities later charged him with helping Sanchez-Olmo during holdups in Garfield, Elmwood Park and Hasbrouck Heights.
“I need a few more weeks,” Miller told the judge.
“It’s been almost five months,” DeAvila-Silebi said. “I’ll give you two more weeks, until Sept. 12.
“If it’s not done by then, the case will be dismissed with prejudice.”
That means prosecutors wouldn’t be able to bring new charges stemming from the same crimes.
Authorities said they found Sanchez-Olmo hiding in a dumpster in Lodi barely 100 yards from an Essex Street 7-Eleven that he’d just robbed of $100 at gunpoint.
The weapon turned out to be a BB gun, sources told CLIFFVIEW PILOT.
The arrest ended a holdup spree in the four towns, authorities said.
Wellington was being held on $1.1 million bail in the Bergen County Jail.
Sanchez-Olmo remained held on $2.25 million bail.
