Nicholas McKay was recovering at Hackensack University Medical Center with what responders told Daily Voice was a skull fracture after the 12:30 a.m. crash Sunday at Niagara Street, south of West Madison Avenue.
Investigators were preparing charges against McKay for DWI, driving while suspended, reckless driving, and having an open container of alcohol in a motor vehicle, Lt. Vincent Tamburro said.
Officers responding to several calls of a vehicle on the CSX tracks saw the train hitting the truck, sending it spinning against a tree, Tamburro said.
Sgt. James Kaine and Officer Dante Rufo got McKay out of the truck, which was leaking fuel and other fluids, the lieutenant said.
They administered first aid, he said.
Responding agencies included the Dumont Fire Department, Dumont Volunteer Ambulance Corps., Hackensack MICU, Cresskill Police, CSX Police, and the BC Sheriff's Office Bureau of Criminal Identification.
