Saddle Ridge Developers Appeal Easton Decision

EASTON, Conn. — Saddle Ridge Developers LLC have appealed the Conservation Commission's decision to deny the application for 99 townhouses with 30 percent affordable units.

Saddle Ridge Developers, Marolyn Stone and Silver Sport Associates LP filed the appeal with state Superior Court on Aug. 3. The commission denied the application on July 12.

The plaintiff says the commission acted beyond its power by basing its denial on activities outside the upland review area and imposes an "arbitrary and excessive" fee on Saddle Ridge's application. The appeal also says there is no evidence of an adverse impact on wetlands; the decision is "illegal and arbitrary" because the developers hold a wetlands permit in the upland review area and the commission attempts to deny the same activities; the commission did not identify new regulated activities; and the decision was predetermined "based on opposition and animus to affordable housing in Easton."
