Samantha Cuevas was charged with custodial interference, although she claims she has legal custody of the girl in New York, according to the Advocate.
A Silver Alert has been issued for the girl, but police did not believe she was in danger, the story said.

Cashmere Robinson is 5 feet tall and weighs 100 pounds. She has brown eyes and black hair and was last seen wearing a burgundy shirt, jeans and Michael Kors boots.
Police told the Stamford Advocate that a surveillance camera in a nearby alley caught Cuevas cutting out the screen on the window of her daughter's bedroom and luring her out on Wednesday afternoon.
The girl was then reported missing by her grandmother, who is her legal guardian.
