Daniel Burby, 27, of Fairfield, CT, accelerated his black Nissan Altima past the security gate at a container terminal off Marsh Street in Newark yesterday afternoon around 2:30, the authority’s Joseph Pentangelo said.

“It’s a very sensitive location labeled as such by the government, due to shipping, Port security, etc.,” Pentangelo said.

After entering the container terminal, the Altima got wedged between two tractor-trailers and could no longer move, he said.

Burby “would not respond to officers’ requests to exit the vehicle,” which continued to run, Pentangelo said. Instead, he said, Burby “repeatedly placed his hand on the gear selector.”

The officers deflated the vehicle’s tires and awaited an emergency service unit.

Burby continued to remain behind the wheel of the idling Altima after the special officers arrived, Pentangelo said. So they broke the window, shut off the engine and took him into custody.

“Federal authorities were notified due to the sensitive nature of the location and the incident,” Pentangelo said. There were no injuries and  minimal damage to property, he said.

Burby was charged with trespassing and obstruction.

“Given the sensitivity of the location, the officers employed great restraint and sound tactics to bring this to a safe conclusion,” Petangelo said.
