According to the victim, Fitho Mettellus, 45, had hit her and pushed her out of the car while in the parking lot of the Stop and Shop on Villa Avenue in the middle of an argument. When she was out of the car, she reported that she tried to use her cellphone to call 911 but was stopped when Mettellus took the phone of her hand and smashed it on the ground before picking up the pieces and leaving the area.
The victim was able to contact police a short time later when a passer-by let her borrow a phone.
When police arrived, they were able to corroborate most of the victim's story by watching a security video of the parking lot.
In the video, police saw Mettellus push the victim and smash the phone on the pavement, but not push her out of the car.
Police charged Mettellus with second-degree breach of peace and interfering with an emergency call. After being processed at headquarters, he was released with a court date of Monday, April 21. No information regarding his court appearance was known at time of reporting.
