Alberto Botero, 39, was arraigned in Westchester County Court on Tuesday, Aug. 11, in connection with the alleged attack at a Greenburgh residence on Wednesday, July 1, Westchester County District Attorney Susan Cacace announced on Tuesday.
The incident began at around 6:25 p.m. when a woman went to the entrance of her home to retrieve a delivery and encountered Botero outside, prosecutors said.
Because she believed he was the courier, she tried paying him before he allegedly grabbed her hand and forced his way into the residence, according to the DA's Office.
The victim tried closing the front door before running upstairs. At this point, Botero chased after her, grabbed her by the neck, and forced her onto a sofa. He then got on top of her and tried pulling her dress up while taking off his pants, prosecutors alleged.
However, the victim's mother then began hitting Botero with a broom, yelling at him to let her daughter go, the DA's Office said.
Botero then moved to attack the mother, pushing her to the ground and dragging her by her hair before allegedly pinning her down and squeezing her neck, according to prosecutors.
The daughter then began trying to fight Botero off by throwing objects at him to stop him from attacking her mother. She then ran downstairs and out of the residence, prompting Botero to follow her outside.
At this point, Greenburgh Police officers arrived at the scene and took Botero into custody, arresting him at the scene while the victims received medical treatment.
Botero was indicted on charges including first-degree burglary, first-degree burglary as a sexually motivated felony, attempted first-degree rape, attempted first-degree sexual abuse, and second-degree assault.
He was also indicted on three counts of criminal obstruction of breathing and blood circulation and two counts of second-degree unlawful imprisonment.
Botero pleaded not guilty and remains held at Westchester County Jail. His next court appearance is scheduled for Tuesday, Nov. 24.
