Robert Smith, 55, was sentenced Tuesday, May 26, in Orange County Court to 13 years behind bars followed by five years of post-release supervision after previously being convicted by a jury of second-degree robbery, Orange County District Attorney David M. Hoovler said on Tuesday, May 26.
As Daily Voice previously reported, the robbery happened around 1:10 p.m. on Saturday, Oct. 12, 2024, in the City of Newburgh.
Prosecutors said Smith was riding a bicycle when he approached a man on the street and demanded money. When the victim refused and continued walking away, Smith got off the bike and punched the man multiple times.
The assault caused the victim to fall backward and strike his head on the pavement, prosecutors said. Smith then allegedly went through the victim’s pockets, stole property, and fled the scene.
Although the victim later died from causes unrelated to the attack before the case went to trial, prosecutors said the conviction was secured through witness testimony and other evidence presented to the jury.
