Norwalk Man Charged in Convenience Store Robbery

NORWALK, Conn. – A Norwalk man has been charged in a Wednesday afternoon robbery of a New Canaan Avenue convenience store.

Damien Maxwell, 27, of 13 Autumn St. wrote a note on a torn lottery ticket to threaten the clerk at Jet Variety with a gun at about 1:30 p.m., according to papers filed at Norwalk Superior Court. The frightened clerk handed over four $10 bills and called police as soon as Maxwell left the store. The suspect was apprehended on the New Canaan Avenue bridge by Officer James Wright.

The clerk and two witnesses identified Maxwell as the robber, papers say. Maxwell did not have a gun or the cash on him, but did have a lottery pencil in his pocket.

The clerk had just come to the store so his sister could leave to have lunch. Maxwell, a regular customer, passed the sister on his way into the store and said hello, according the accounts filed at court. He lingered near the lottery counter until other customers left and then presented the note saying, “I have a gun.” He said nothing and left with the cash.

After being apprehended, Maxwell was handcuffed and put in a patrol car. When police took him out of the car to give the witnesses a chance to identify him, they discovered that one of his hands was out of the handcuffs. He was holding his arms behind him as though they were cuffed. He was shoved back into the vehicle and handcuffed again.

Police checked the National Crime Identification Center and found nothing on Maxwell, but the Interstate Identification Index showed that he has a F.B.I. number and has other records held by the state of Connecticut.

He was charged with robbery first degree and interfering with an officer. He is being held on $25,000 bond ordered by Judge Bruce Hudock.
