On Sunday, Oct. 11 at Boatyard 401 in Point Pleasant, Michael Barone physically assaulted the victim, bit a portion of his ear off and choked him, according to a criminal complaint issued by the Point Pleasant Police Department.

The altercation began when Barone and John Hafner, both Toms River residents, were following a woman around and she asked them to stop, Patch reported, citing the court hearing statements made in court. A man attempted to intervene and was attacked by Barone and Hafner, Patch reported.

Barone is accused of physically assaulting the victim, biting off part of his ear and choking him, according to the complaint. Hafner struck the victim several times while he was incapacitated and being assaulted by Barone, according to a separate complaint.

"The victim is missing half of his right ear and has red marks on his neck from being choked," the complaint reads.

Barone admitted getting into an altercation with the victim, and surveillance footage captured the assault, according to the complaint. He appeared to be under the influence of drugs or alcohol when he was arrested, police said. The victim told officers he would seek  his own medical treatment.

The men are charged with aggravated assault, simple assault and disorderly conduct.
