Peekskill resident Manuel V. Carchipulla Lupercio, 52, was arrested on Sunday, Aug. 2, after a traffic stop in Peekskill, New York State Police announced on Monday, Aug. 3.
The traffic stop happened at around 2:49 a.m. on Sunday, when troopers saw Carchipulla Lupercio's vehicle traveling northbound on Smith Street in Peekskill while allegedly violating vehicle and traffic laws.
After pulling him over, State Police said they found that Carchipulla Lupercio was showing signs of intoxication during the investigation. To make matters worse, troopers also discovered that a 9-year-old child was riding in the vehicle, police said.
Carchipulla Lupercio was taken in for processing, where he submitted to a chemical breath test that measured his blood alcohol content at 0.12 percent, police said.
The child was later safely released to a sober third party.
Carchipulla Lupercio was charged with aggravated driving while intoxicated with a child passenger under Leandra's Law, along with misdemeanor counts of driving while intoxicated with a blood alcohol content of 0.08 percent or higher and driving while intoxicated.
He was arraigned in White Plains City Court and released on his own recognizance. He is scheduled to appear in Peekskill City Court on Aug. 6, at 9:30 a.m.
