McIver had previously said she made the decision to get pregnant despite the federal case against her.
“People might find it crazy that even though I’m facing 17 years in prison, I made the decision to get pregnant," she said on X. "But, at the end of the day, this is something I couldn’t let be consumed by this administration. I refuse to let them take my joy or my future.”
The baby is McIver's second child with husband Khalif Thomas. She announced her pregnancy in May, saying she and Thomas had been trying for another child.
McIver's legal battle stems from a May 9, 2025 confrontation at the Delaney Hall Federal Immigration Facility in Newark, where she and fellow Reps. Bonnie Watson Coleman and Rob Menendez had gone to conduct congressional oversight.
Federal prosecutors allege McIver interfered with officers attempting to arrest Newark Mayor Ras Baraka. According to the indictment, McIver placed her arms around Baraka as officers tried to arrest him and later struck two officers with her forearms.
McIver has pleaded not guilty and maintained that she was carrying out her congressional oversight duties.
If convicted, McIver faces up to eight years in prison on each of two forcible impeding and interfering charges and up to one year on a third charge.
A federal appeals court in August allowed the first two counts to proceed while sending the third back to the lower court for further review.
