Aaron Bernstein, a Marlboro resident, was indicted by a grand jury on two counts of official misconduct, perjury, aggravated assault and possession of a weapon for an unlawful purpose, Mercer County Prosecutor Janetta Marbrey said.

On Tuesday, May 10, 2022, Bernstein used pepper spray against a 27-year-old Trenton man, in violation of the New Jersey Attorney General’s Use of Force Policy, Marbrey said.

Bernstein then filed charges of obstructing the administration of law and resisting arrest against the victim in connection with same incident, making false statements, Marbrey said.

He had been on the force for 19 years, Marbrey said.
