US Air Force Veteran, Daniel Harry Messimer, 59, of Lititz, is charged with felony Interception of Oral Communications. He leads the Veterans of Foreign Wars Post at 141 South State Street, where the recording allegedly took place on July 1, 2024.
According to an affidavit of probable cause obtained by Daily Voice on Thursday, May 8, the case began on Jan. 8, 2025, when the victim reported her suspicion to police after learning Messimer had emailed others quotes from a conversation she believed was private.
She told police she had been in the VFW office with another person, unaware the camera system was recording audio. There was no signage indicating audio surveillance, she said.
Police say Messimer confirmed in an interview that he emailed an audio/video recording of the conversation to a woman on Jan. 23, 2025, using the address [email protected]. The next day, that woman turned over the email and footage to investigators.
The email from Messimer reportedly read: "I thought I would share a portion of this video with you because we didn't get to watch it because of lack of time at our meeting last week."
Detectives reviewed the file and confirmed it was a recording of the victim’s conversation from July 1.
Messimer denied turning on the audio system intentionally but admitted to sending the footage, police wrote in the affidavit.
The longtime VFW leader was arraigned Monday, May 5, 2025, before Judge Tony S. Landis and released on $15,000 unsecured bail.
The VFW has not publicly responded to the allegation.
