ARMONK, N.Y. -- The agreement announced last week between Michael Fareri, the Armonk developer who filed an Article 78 petition against Armonk Square, and Armonk Square developer Dominick Dioguardi to allow Armonk Square to proceed, is still pending.
The parties signed an initial agreement but must still approve a full-scale site plan that shows specific changes to the property the parties agreed to.
Bob Green, chair of the North Castle Planning Board, said the key change is Fareri's agreement to let Armonk Square utilize a driveway next to Cocobolo, a Fareri property on Maple Avenue. The driveway will be used for a truck entrance.
"Mr. Fareri has agreed to take down a fence and utilize his property so they can both use the driveway, so all will have easier access," Green said.
Green said the initial agreement was signed by Fareri, Dioguardi and town officials, including Green and Supervisor Howard Arden. The final agreement with the updated site plan could be completed by end of this week. Once it's completed it will be filed with the New York State Supreme Court.
Green said the Article 78 petition Fareri filed against the town of North Castle and the Armonk Square developers will be inactive after the agreement is signed. Fareri declined to comment on the petition and a Harris Beech lawyer who represents him did not return calls for comment.
