Affidavit: Driver Unaware She Hit Man

Kate Regan was not aware that she had hit a person on the August afternoon her SUV struck and fatally injured Krishna S. Jayaraman on Oenoke Ridge Road, says an affidavit from New Canaan Police.

According to the seven-page document, on file in Norwalk Superior Court, Regan, a New Canaan resident, told police that she was driving to Loudonville, N.Y., on Aug. 18 to meet her husband, Michael, at a wedding. She said she never saw Jayaraman, 84, when she drove past his home at 1769 Oenoke Ridge Road at about 4:15 p.m. and did not initially know she had hit him. After hearing about the accident and reviewing the damage to the passenger side of her Infiniti QX56, she said she realized that her car had struck Jayaraman.

Jayaraman died that day at Norwalk Hospital after suffering "multiple traumatic blunt injuries." Regan, 32, was charged Nov. 3 with negligent homicide with a motor vehicle and evading responsibility resulting in physical injury or death.

According to the affidavit, Michael Regan told police Aug. 19 that his wife told him she was "changing a DVD and veered over" while driving and thought she had "hit a mailbox" just over the New York state line. Regan was driving with her 19-month-old son at the time, according to the document. Regan stopped at a gas station in Pound Ridge, N.Y., to review damage to the passenger side mirror.

The document also said Regan told police that she parked her vehicle in two different locations Aug. 18 while running errands and discovered the vehicle was damaged somewhere in New Canaan and had not noticed the damage until she got home.

According to the document, Michael Regan called police and told him he asked his wife about hitting a mailbox. Police said Regan told her husband that she lied to him because "she was afraid he would be furious" about damaging the vehicle "so foolishly by hitting a mailbox." The affidavit said Regan was "extremely distraught" when she realized she may have been involved in a serious accident.

Regan is scheduled to appear Nov. 23 in Norwalk Superior Court.
