Tyshaun Harvey, of Pottstown, was nabbed this week at a motel in Susanville, CA, near the Nevada border, Montgomery County District Attorney Kevin R. Steele said Wednesday, Aug. 10.

He's awaiting extradition to Montgomery County on charges of first-degree murder, person not to possess a firearm, recklessly endangering another person, and related offenses in the Sunday, May 29 killing of 22-year-old Nahmer Baird, Steele said alongside Pottstown Police Chief Mick Markovich.

Baird, of Pottstown, was driving a white Nissan Sentra down the 400 block of West Street when there was an "exchange of gunfire" with a black Chrysler 300 around 8:10 p.m., the DA previously said.

He then drove for two blocks before crashing head-on into a Dodge pickup truck and injuring the driver.

Baird was taken to Pottstown Hospital, where he was pronounced dead at 8:44 p.m., while the pickup driver was taken to Reading Hospital for treatment and later released, authorities said.

Detectives say they recovered Harvey’s Chrysler 300 in Pottstown the day after the shooting. The vehicle had a bullet hole in the front windshield and three other bullet strikes to the front and passenger side of the vehicle, they said.

Harvey was also out on $100,000 bail at the time of the shooting, investigators said.

In that case, Harvey has been charged with multiple felonies including aggravated assault stemming from a shooting that happened in Pottstown on March 29, 2021.

“U.S. Marshalls did an excellent job in finding this dangerous criminal and working to safely get him off the streets after he fled to California,” DA Steele said.

The case will be prosecuted by Assistant District Attorneys Samantha Cauffman and Caitlin Wilenchik.
