Man Sentenced For Pulling Gun On Westchester Pharmacist

A Putnam County man is heading to prison for his role in the daytime attempted armed robbery of a pharmacy in New Rochelle.

Mahopac resident Brian Dias, 32, has been sentenced to two 10-year terms in prison, followed by five years of post-release supervision after pleading guilty to attempted robbery and criminal possession of a weapon - both violent felonies - last year.

Dias’ co-defendant Tiana Spearmon, 23, who pleaded guilty in October last year to attempted criminal possession of a weapon, had her sentence adjourned until March 7, Westchester County District Attorney Anthony Scarpino, Jr., said.

Dias and Spearmon drove to Main Street Pharmacy in New Rochelle at approximately 3:15 p.m. on July 13 last year. While Spearmon waited in the car, Dias went into the store, put on a mask and gloves and then pulled out a loaded handgun. He pointed the gun at the pharmacist and demanded money.

The pharmacist refused to hand over any cash, telling Dias “just shoot me, then,” Scarpino said. No shots were fired and Dias left without taking anything.

Scarpino said that on his way out, Dias dropped a black left-handed glove, which was recovered by investigators from the New Rochelle Police Department. Investigators caught the two leaving on surveillance camera and tracked it through New Rochelle.

Police were able to identify the Georgia license plate and then used that to locate the pair on July 22. A search warrant was executed on Dias’ car and a loaded firearm, mask and matching right-handed glove were recovered.
