SPRING VALLEY, N.Y. -- A judge found a Spring Valley man guilty of criminally negligent homicide for his role as the driver in a 2013 car crash on Palisades Interstate Parkway in Orangetown that took the life on one of his best friends, according to lohud.com.
Sentencing for Phylip Derival is scheduled for Thursday, Oct. 27. He could be sentenced to up to four years in prison following his bench trial, says lohud.com.
Prosecutors said the conviction is a strong reminder to drivers to use care on the roads. Authorities said Derival was driving in excess of 90 mph on Aug. 14, 2013, when he tried to pass between two cars, then lost control of his car and hit a tree, reports lohud.com.
His 26-year-old passenger, Justin Goings of Haverstraw, was killed instantly. At the time of his arrest, his lawyer said Derival, who was reportedly sober at the time, suffers regret from the accident, lohud.com says.
