Spierer disappeared four years ago while attending Indiana University.

The lawsuit alleged the last three people to see Spierer alive caused an injury related to her disappearance, according to WRTV-6.

The original decision last October threw out the lawsuit on the grounds that a disappearance was "not an injury" and the Spierer family was "fishing for evidence," according to WRTV-6.
