The New York State Division of Criminal Justice Services issued an alert on Thursday to Westchester residents regarding the residency of 46-year-old Timothy Smith, who has moved to an apartment on Albany Post Road in Hyde Park.

The Division of Criminal Justice Services has assigned Smith as a Level 2 threat, which means he is at "moderate risk of a repeat offense."

According to the Division of Criminal Justice Services, Smith had sexual intercourse with his victim in 1995 and was convicted of a non-felony sexual offense the following year. Smith was sentenced to 10 years probation and is now under the jurisdiction of the Hyde Park Police Department.
