Man Hits Victim With Beer Bottle At Westchester Gas Station, Police Say

A 29-year-old man is behind bars after police say he punched a victim with a beer bottle in his closed fist in Northern Westchester.

State Police responded to the Oregon Road Shell gas station in the town of Cortlandt for a physical domestic violence incident on Friday, July 5 at approximately 12  p.m.

The Investigation determined David L. Herbin, 29, of Cortlandt poured beer over the head of the victim, and then punched the victim with a beer bottle in his closed fist, causing injury, state police said. 

Further investigation determined there was a valid order of protection in place in favor of the victim.

Herbin was charged with second-degree assault, criminal possession of a weapon in the third degree, and aggravated criminal contempt, all Class D felonies.

Herbin was arraigned before the town of Cortlandt Court, and remanded to the Westchester County Jail in lieu of $25,000 cash bail or secured bond.
