3 Family Members Illegally Possessed Almost 50 Guns In North Castle: DA

Three family members who live in the same Northern Westchester household face numerous weapons charges after they were discovered to be in possession of nearly 50 illegal guns including semi-automatic rifles and machine guns, officials said.

The three defendants, all residents of North Castle, were arraigned in Westchester County Court on Tuesday, May 9 on an indictment alleging the illegal possession of the weapons, according to the Westchester County District Attorney's Office. 

They are identified as Theodore Brois, age 68; Brandon Brois, age 25; and Helene Brois, age 63. 

The trio was arrested on Jan. 25, 2022, just before 11:30 a.m., when North Castle Police seized 48 guns from several rooms in the house, including at least 15 that were loaded. 

The house allegedly contained semi-automatic rifles, shotguns, machine guns, and an unregistered "ghost gun." 

All three suspects had no permits to legally purchase or possess firearms, officials said. 

The three family members all face several charges individually. 

Theodore Brois is charged with: 

  • First-degree criminal possession of a weapon;
  • Criminal possession of a firearm;
  • Second-degree criminal possession of a weapon related to the alleged possession of five or more firearms;
  • Eight counts of second-degree criminal possession of a weapon related to the alleged possession of loaded assault weapons;
  • 12 counts of third-degree criminal possession of a weapon. 

Brandon Brois is charged with: 

  • Second-degree criminal possession of a weapon related to the alleged possession of a loaded pistol;
  • Second-degree criminal possession of a weapon related to the alleged possession of loaded assault weapons;
  • Four counts of third-degree criminal possession of a weapon;
  • Nine counts of fourth-degree criminal possession of a weapon. 

He also had a prior conviction of second-degree criminal possession of a weapon, prohibiting him from legally possessing any firearm. 

Helene Brois is charged with: 

  • Criminal possession of a firearm;
  • Second-degree criminal possession of a weapon related to the alleged possession of five or more firearms;
  • Two counts of second-degree criminal possession of a weapon related to the alleged possession of loaded assault weapons;
  • Three counts of third-degree criminal possession of a weapon. 

North Castle Police Chief Peter J. Simonsen said that the investigation and arrests were "proactive in nature."  

"It is most probable that this initiative, and its success, has prevented loss of life and victimization," he added. 

"This case is another result of our strong partnership with local police to ensure greater public safety by seizing illegal guns and preventing these deadly weapons from infiltrating our communities," said Westchester County District Attorney Miriam Rocah.
