Beach Haven officials on April 20 denied Holiday Snack Bar a mercantile license for the 2023 season.

That means the restaurant can't operate past Sunday, May 14, when its current license expires.

The 75-year-old restaurant is on the corner or Centre Street and North Delaware Avenue.

Beach Haven Clerk Sherry Mason said she met with restaurant owner Eileen Bowker on Wednesday, May 10 and provided a new application.

Mason said she thinks the differences can be resolved.

"We don't want to see them shut down," Mason said. "Beach Haven is all about the business district and amenities."

The differences apparently centers on outdoor dining.

Holiday Snack Bar is in a residential district and has a non-conforming structure, Mason said.

All temporary approvals granted during COVID have expired, she said.

"It was never our intention to have to slam the town, or bring bad press," Holiday Snack Bar wrote. "However their most recent decision has left us with no other option. Their tactics thus far have involved: selective enforcement, intimidation, harassment, threats and bullying."

"One of our good friends told us 'Do right and fear no one.' So for today and moving forward that is our plan," the restaurant said.
