FORT LEE, N.J. -- A former Leonia Board of Education member who resigned after state authorities charged him with sexually touching three different patients at his chiropractic office in Englewood has agreed to a temporary license suspension, authorities announced Wednesday morning.

Archer L. Irby, 45, signed a consent order with the state a day before he was scheduled to appear before the Board of Chiropractic Examiners, state Attorney General Christopher S. Porrino said.

Irby, who owns Irby Spinal Care, "engaged in gross or repeated malpractice, professional misconduct, and behavior that served his personal prurient interests,” Porrino said.

Irby "hid behind his chiropractic license to use patients for his own sexual gratification,” the attorney general said. “This kind of alleged depraved behavior is a stain on the health care professions that will not be tolerated."

Under the terms of the consent order, Irby’s license will remain suspended until the criminal case is resolved and the committee can consider the results, the attorney general said.

Meanwhile, he remained free on $7,500 bail, charged with criminal sexual contact, attempted criminal sexual contact and lewdness.

Irby, who is married and lives in Leonia, first posted $2,500 bail after a woman who’d just been in for treatment at Irby Spine Care on Grand Avenue notified authorities, acting Bergen County Prosecutor Gurbir S. Grewal said at the time.

Additional charges were brought two days later following additional complaints, he said.

A 46-year-old female patient alleged that Irby touched her breasts inappropriately while treating her for neck pain, said Porrino, the state attorney general.

"Although she felt uncomfortable by Irby’s actions - which deviated from past treatments she’d received from him - she trusted that the treatment was medically necessary," he said.

"But when Irby touched her inappropriately and put his mouth on her bare breast while treating her two days later on July 30, the patient ran from the office and filed a report with the Englewood Police Department," Porrino said a complaint alleges.

Another woman told police Irby "touched her inappropriately and exposed he penis while treating her" on separate occasions, according to the complaint.

Another woman alleged Irby inappropriately touched her during treatment in October 2012.

“By obtaining the temporary suspension of Dr. Irby’s license, the Board has acted swiftly to ensure that he will not have contact with patients while these very serious charges are pending,” Steve Lee, director of the state Division of Consumer Affairs, said Wednesday.

The Enforcement Bureau of the state DCA coordinated the investigation, with Deputy Attorney General Christopher Salloum handling the prosecution.
