US District Judge James Boasberg, presiding in the District of Columbia, announced in a 46-page decision released on Wednesday, April 16, that the administration has failed to comply with his directive issued last month, which mandated an immediate suspension of deportations under the Alien Enemies Act.
On Saturday, March 15, the federal government invoked the 1798 Alien Enemies Act to target individuals associated with Tren de Aragua, a Venezuelan prison gang alleged to be infiltrating the United States.
Following this invocation, several flights were dispatched to El Salvador carrying purported gang members, including 137 individuals, despite legal challenges initiated by the American Civil Liberties Union and Democracy Forward, which argued that deportations occurred without due process.
Boasberg said the government's actions "demonstrate a willful disregard" for his order.
"The Constitution does not tolerate willful disobedience of judicial orders," Boasberg wrote, "especially by officials of a coordinate branch who have sworn an oath to uphold it."
