Former SHU Student Charged With Illegally Taking Nude Photos Of Another Student

A former Sacred Heart University student has been arrested by police for disseminating nude photographs of a female student, police say.

The incident took place on Oct. 6, 2019, when a female Sacred Heart University student reported to police that she believes she was the victim of a sexual assault, said Capt. Brian Fitzgerald of the Bridgeport Police Department.

The victim reported that she was intoxicated in the early morning hours and believed that a man, she identified as Nicholas Otto-Bernstein, 20, of New York City, had sexual intercourse with her without her consent, Fitzgerald said.

The victim also told police that a nude photograph of her was circulated online on Snapchat, he added.

According to the victim, the photograph was taken without her consent. 

Investigators were able to determine that Otto-Bernstein took the nude photograph of the victim and disseminated it online to other students, Fitzgerald said.

Otto-Bernstein reportedly withdrew from the college following the incident and investigation.

Detectives did not have probable cause to charge Otto-Bernstein with sexually assaulting the victim, Fitzgerald said. 

Detectives did have probable cause for and obtained a warrant for Otto-Bernstein's arrest for voyeurism, unlawful dissemination of an intimate image, dissemination of voyeuristic material. 

He is free on a promise to appear ticket in court on Friday, Feb. 28.
